Terms of Service

§ 1 Scope and Provider

(1) These Terms of Service apply to the use of the Reasoned platform (hereinafter "Platform"), accessible at reasoned.de.

(2) The provider is the Reasoned Project. For legal inquiries, please use our contact form.

(3) Use of the platform is free of charge. No costs arise from registration or use of the offered features.

§ 2 Service Description

(1) Reasoned is a platform for structured, source-backed debates. Users can create debates, submit arguments, rate arguments, and add source citations.

(2) The provider supplies the technical infrastructure but assumes no editorial responsibility for user-generated content to the extent permitted by law.

(3) The provider reserves the right to change, restrict, or discontinue the scope of services at any time.

§ 3 Registration and User Account

(1) Certain features (e.g., creating debates and submitting arguments) require registration. Registration is open to persons aged 16 and over.

(2) Accurate information must be provided at registration. Sharing access credentials with third parties is prohibited.

(3) Users are responsible for all activities carried out through their account.

(4) The user account may be deleted at any time via account settings. Upon deletion, personal data is removed; created content is anonymized to preserve debate integrity.

§ 4 User Obligations and Prohibited Content

(1) Users agree to only post content that is:

• factual, evidence-based, and source-referenced,
• free from third-party rights violations (especially copyright, personality rights),
• not offensive, discriminatory, inciting, or hate-speech,
• not spam, advertising, or misleading content.

(2) In particular, the following content is prohibited:

• content violating §§ 86, 86a, 130 StGB (incitement to hatred, use of unconstitutional symbols),
• glorifying or inciting violence,
• content constituting a criminal offense under German law,
• knowingly false statements of fact (disinformation).

(3) The provider may remove content violating these terms at any time without notice, and may suspend or delete affected accounts.

§ 5 Copyright and Usage Rights

(1) Users retain copyright over the content they create.

(2) By posting content, users grant the provider a non-exclusive, royalty-free, worldwide right to store, display, and distribute the content within the scope of platform operation.

(3) Users warrant that they have the right to use the content they post and that no third-party rights are infringed.

§ 6 Limitation of Liability

(1) The provider is not liable for the accuracy, completeness, or timeliness of user-generated content.

(2) No warranty is given for technical failures, data loss, or interruptions to platform availability.

(3) The provider's liability is limited to cases of intent and gross negligence, unless mandatory statutory provisions apply.

(4) The limitation of liability does not apply in cases of injury to life, body, or health.

§ 7 Suspension and Termination

(1) The provider is entitled to temporarily suspend or permanently delete user accounts in case of violations of these Terms.

(2) Users may delete their own account at any time via account settings.

(3) Users whose accounts have been suspended by the provider may appeal via the contact form.

§ 8 Privacy

The processing of personal data is governed by our Privacy Policy, which forms part of these Terms of Service.

§ 9 Changes to Terms

(1) The provider reserves the right to modify these Terms at any time.

(2) Material changes will be communicated to users by email or by a prominent notice on the platform. Continued use of the platform after changes take effect constitutes acceptance.

§ 10 Final Provisions

(1) The law of the Federal Republic of Germany applies, unless mandatory consumer protection provisions of the user's country of residence take precedence.

(2) If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.

(3) We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
